for the Sierra Wireless AT&T Developer Summit Promotion

1. NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
2. Entry Period/Eligibility: The “Sierra Wireless AT&T Developer Summit Promotion” (the “Promotion”) will take place during the AT&T Developer Summit to be held at the Palms Hotel in Las Vegas, Nevada on January 9th, 2012 at 11:15 a.m. PST through January 9, 2012 at 4:00 p.m. PST (“Promotion Event”). The Promotion will end on January 9, 2012, at 4:00 p.m. PST or when all Prizes have been awarded, whichever occurs first (“Promotion Period”). All interpretations of these Official Rules and decisions made by Sponsor relating to the Promotion are final and binding. The Promotion is open to registered attendees at the AT&T Developer Summit who attend the Promotion Event during the Promotion Period. Entrants must be at least 18 years of age or older at time of entry. Entrants who are 18 but have not yet reached the age of majority in the jurisdiction in which they reside (“Minors”) must obtain parental or legal guardian consent to be eligible to enter the Promotion. Employees of Sierra Wireless America, Inc. (“Sponsor”) and its parent company, affiliated companies, subsidiaries, advertising agencies, promotion and administration agencies, AT&T Mobility LLC and its affiliates, and any entity which is involved in any aspect of the creation, production, operation, execution or fulfillment of the Promotion, and their respective agents, employees, officers, directors, successors and assigns (“Promotion Entities”), and their immediate families (i.e., parents, spouse, siblings, children, grandparents, step parents, step children and step siblings, and their respective spouses, and those living in the same household, whether or not related) are not eligible to enter the Promotion. By participating in this Promotion, entrants: (a) agree to be bound by these Official Rules and by the decisions of Sponsor which are final and binding; (b) acknowledge compliance with these Official Rules; and (c) agree to comply with any and all applicable federal, state and local laws, rules and regulations.
3. To Enter: Participants must stop at the Sierra Wireless booth at the Promotion Event during the Promotion Period, scan the badge they received to attend the Promotion Event. By scanning the Promotion Event badge, participants will provide Sponsor with their contact information and be eligible to play “Elevate Your Game” (the “Game”). Once the participant’s Promotion Event badge is scanned, participants will input a game name into a game tablet. The participant’s game name will appear on the game tablet and game board. Up to 5 registered players can play at a time. The Game randomly selects who will go first. A participant can play the Game more than once but is limited to only winning one (1) prize. All entries submitted in compliance with these Official Rules and not disqualified are considered “Eligible Entries”. All entries become the sole and exclusive property of Sponsor. Entries will not be returned and receipt of entries will not be acknowledged. Sponsor will be collecting personal data about entrants in accordance with its Privacy Policy. By participating in this Promotion, entrants hereby agree to Sponsor’s collection and usage of their personal information and provision of such information to its business vendor, AT&T Mobility LLC, and acknowledge that they have read and accepted Sponsor’s Privacy Policy, which is available at www.sierrawireless.com/privacy. All information provided to AT&T Mobility LLC will be used in accordance with its Privacy Policy, which is available at www.att.com/privacy.
To play:
- Clue appears and game begins.
- 1st contestant hits a spin button on the tablet.
- The wheel stops on a number of points that can be won.
- Contestant has predetermined amount of time to guess a letter.
- If they don’t guess in time, turn passes to next contestant.
- If correct, letter appears in 1 or more places, points per letter are added to players score, and they get to guess or take another spin. Contestants are only allowed 2 spins per turn.
- If wrong, turn passes to next contestant.
- Play continues until someone guesses the answer.
- Two winners each round: First contestant to solve the questions and contestant who earns the highest score.
- If first contestant and highest scorer are the same person, only one prize is granted
- If wheel stops at section marked PRIZE on the wheel, contestant instantly wins and the remaining contestants play to solve the puzzle
- If puzzle is NOT solved before the game time limit runs out, answer is shown onscreen and two highest scorers win prizes
4. Prizes/Odds: There will be up to 100 winners (“Winner(s)”) during the promotion period with two winners each round. Winners are determined by the number of points earned during the Game or if the puzzle is solved. Each Winner will each receive one of the following Prizes:
- 75 - AT&T Mobile Hotspot Elevate 4G device including a protective case selected by the Sponsor, a desktop cradle selected by the Sponsor. Value of each device with accessories is $364.00 USD and there will be 75 available to win during the Promotion Event.
- 25 - AT&T USBConnect Momentum 4G device. Value of each device is $230 and there will be 25 available to win during the Promotion Event.
- 25 – AT&T Prepaid Mobile Broadband Dataconnect Pass, $50, 1GB. Value of each Dataconnect Pass is $50 and there will be 25 available to win during the Promotion Event.
Wireless and data contracts are not included with any Prize. The approximate retail value (“ARV”) of all the Prizes is $34,800. The odds of winning will depend on the number of Eligible Entries received during the Promotion Period. All prizes may not be awarded during the Promotion Period.
5. Winner Selection/Verification: Winners will receive their Prize immediately upon completion of the Game. By entering this Promotion, entrants grant to Promotion Entities, except where prohibited by law, the full permission and authority to use entrant’s name, picture and/or likeness, or biographical information or voice for trade, advertising and publicity purposes, in any media now known or hereafter devised, throughout the world, in perpetuity, without additional compensation or consideration or notification. Winner will forfeit Prize if they do not immediately accept the Prize or complete the Winner Release Form.
6. Prize Terms/General Terms: The dates for fulfillment of the Prizes will be during the Promotion Event, but may be subject to change in Sponsor’s sole discretion. If for any reason the Prize is unavailable, Sponsor reserves the right, but is not obligated, to cancel or modify the Promotion in its sole discretion and award a substitute Prize, or portion of Prize, of comparable or greater value. No substitution, transfer, assignment or cash equivalent of the Prizes, or any portion thereof, is permitted by a Winner. Promotion Entities shall have no responsibility or obligation to a Winner or potential Winner who is unable or unavailable to, or who does not for any reason, accept or utilize the Prizes. All costs and expenses not specifically listed above as part of the Prizes are solely Winner’s responsibility. Prizes are provided “as is”. Arrangements for the fulfillment of the Prizes will be made by Sponsor. The value of the Prizes will be taxable to Winners as income. All federal, state and local taxes, and any other costs and expenses associated with acceptance and/or use of Prizes not specifically provided for in these Official Rules are solely the Winner’s responsibility. Promotion Entities are not responsible if the Promotion cannot take place, or if any Prize cannot be awarded due to delays, interruptions or failures due to acts of God, war, natural disasters, weather, acts or threats of terrorism, strikes, lockouts, labor disputes, work stoppages, fire, acts of government, or other events outside of the reasonable control of the Promotion Entities. If, for any reason this Promotion is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Promotion Entities, which, in Sponsor’s sole determination, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend this Promotion or any part of the Promotion. Entrants agree to indemnify and hold harmless Promotion Entities, including, but not limited to AT&T Mobility LLC and its affiliates, from any and all liability arising out of or relating in any way to entrant’s participation in the Promotion and/or the use, misuse or redemption of Prize and to release all rights to bring any claim, action or proceeding against Promotion Entities including, but limited to, AT&T Mobility LLC and its affiliates. Promotion Entities assume no responsibility for and will disqualify entries that are: stolen, late, lost, illegible, incomplete, invalid, unintelligible, damaged, destroyed, delayed, misdirected, not received or that have incorrect or inaccurate entry information, whether caused by any of the equipment or programming associated with or utilized in this Promotion, or by any human, mechanical or electronic error which may occur in the processing of the entries in this Promotion or other errors appearing within the Official Rules or in any Promotion related advertisements. Promotion Entities assume no responsibility for any typographical or other error in the printing of the offer, administration of this Promotion, errors in processing entries, identifying the Winners, in the announcement of the Prizes and Winners, and the delivery of the Prizes. Sponsor reserves the right in its sole discretion to disqualify any person they suspect or find: (i) to have tampered with the entry process or the operation of this Promotion; (ii) to be acting in a disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person; (iii) to display behavior that will bring such Winner or Promotion Entities into disgrace; (iv) to have provided inaccurate information on any legal documents submitted in connection with this Promotion; or (v) to be acting in violation of these Official Rules. Any violation of these Official Rules by a Winner will result in such Winner’s disqualification as a Winner of the Promotion and all privileges as a Winner will be immediately terminated. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAW AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. THE CALIFORNIA COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE PROMOTION AND THE LAWS OF THE STATE OF CALIFORNIA SHALL GOVERN THE PROMOTION. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THESE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THESE COURTS.
7. Request for Names of Winners and Official Rules: All requests for a copy of the Official Rules and for the names of the Winners must be made by April 1, 2012.
